"Walters argued that local community standards, the guiding principle behind implementation of obscenity laws, cannot be applied to the Web, a global venue.

"Any obscenity charge against any Web-site content or Internet content is unconstitutional," said Walters, who specializes in First Amendment law. "There is no commonality based on just geography anymore. It's not the 1800s anymore, not here. But I don't know about Polk County.""

Interesting statement. I do agree with Mr. Walters. I hope the courts do too.

I'm still waiting for some smart lawyer to toss in the hard facts that +70% of hard drives have porn on them. Maybe nobody on the jury would admit it, but, what are they going to do if 9 out of 12 of them have porn on their own computers.

Certain counties will have a much lower percentage of hard drive and this is one of them. In the process of selecting the jury I'm sure one side will be working to fine 12 people that don't have any and the other will do the opposite. I think the one searching for 12 that don't will have an advantage in this county.
