I think the key is "American Library Association v. Reno [1995]" which the DOJ is banking on, without that case the DOJ position would crumble.

I know that I can't violate court orders, so how come these FBI guys aren't setting in a little room with bars?

And that should include any higher ups that pushed for it.

Basically, they are immune from prosecution. With good reason I may add.
Forget the 2257 stuff for a sec, if they didn't have immunity, then Anything undercover would be illegal. It'd be sort of tough to stop a speeding car without speeding yourself.

I don't think disrespecting a judges orders fall under the same thing though.

And any higher-ups probably don't qualify for same kind of immunity as LEOs performing their duty.
