Not sure about Germany, but back when we had similarly draconian laws in the UK, the law was against "creating or uploading" pornographic material. It did not matter where it was hosted, if the website was designed in the country, or it was uploaded from the country, you got sent to jail.

And nowadays it does not even matter if you live outside the country or are a citizen of another country. A short while back a Brit who was running a gambolling site from Britain was arrested at the request of the US government, and sent over there for trial simply because people in the US were using his site!!!!
